Dinipensahan ni House Deputy Majority Leader Lorenz Defensor, isa sa miyembro ng House Prosecution panel, ang kanilang naging hakbang para hilingin kay Senate President Chiz Escudero na pasagutin si Vice President Sara Duterte kaugnay sa impeachment complaint na kaniyang kinakaharap.
Giit niya hindi gagawa ng anumang hakbang ang prosekusyon na labag sa batas at labas sa Senate rules on impeachment.
“Lagi naming irerespeto ang Senate President as the presiding judge ng impeachment court. At gagawa lang kami ng prosesong mga legal based on the existing Senate rules of impeachment. Wala kaming gagawing wala sa legal na pamamaraan, at igagalang namin, kasi katulad nga ng sinabi ko, ang isang judge sa isang trial court, hindi mo naman pwede basta-basta mangbraso ka,” saad ni Defensor sa isang panayam.
Matatandaan na nitong Martes ay inihain ng prosekusyon sa pamamagitan ni lead prosecutor House Minority Leader Marcelino Libanan ang entry with motion to issue summons.
Bagay na ayon kay Libanan ay nakasaad sa umiiral na Senate rules on impeachment trial kung saan dapat pasagutin ng Senado ang respondent sa loob ng sampung araw matapos maihain ang impeachment complaint.
Batay sa inilatag na timeline ni Escudero, sa June 4 pa nila pasasagutin ang bise presidente.
Aminado naman si Batangas Rep. Gerville Luistro na magkaiba ang posisyon ng Senado at ng Kamara.
At bagama’t nirerespeto ang posisyon ng Senado, naninindigan aniya ang Kamara na hindi kailangan na nakasesyon ang Kongreso para simulan ang impeachment dahil kaiba ito sa legislative function ng Kongreso.
“Well, I think it is very apparent that the Senate and the House are very much divided in terms of legal standing on the issue, no? While they maintain the position, nakailangan ang session for them to be able to convince, we maintain otherwise,” paliwanag ni Luistro.
“Kasi ang amin po ang position, we don’t need session to be able to convince an impeachment court because impeachment is entirely different from legislative function. That is what we mean by sui generis. It’s a thing of its own, no? Iba po itong impeachment process from the legislative function of the Senate, which means with or without session the Senate can proceed in convening an impeachment court,” diin pa niya. | ulat ni Kathleen Forbes
