Ipinaalala ni Senate Committee on Labor Chairman Senador Joel Villanueva sa mga manggagawa na maaari silang maghain ng reklamo sa National Labor Relations Commission (NLRC) kung hindi sila bibigyan ng 13th month pay ng kanilang mga employer sa tamang oras.

Kasabay ito ng pakikiisa ng senador sa panawagan ni DOLE Secretary Bienvenido Laguesma sa mga employer na tiyaking matatanggap na ng kanilang mga empleyado ang kanilang 13th month pay hanggang ngayong araw, December 24.

Binigyang diin ni Villanueva na sa ilalim ng Presidential Decree 851, isang legal na obligasyon ang pagbibigay ng 13th month pay.

Ipinunto rin ng mambabatas na sa ilalim ng implementing rules and regulations ng PD 851, ang hindi pagbibigay ng 13th month pay ay kinokonsiderang isang money claim at dapat na maiproseso alinsunod sa rules ng pagpapatupad ng labor code of the Philippines at ng NLRC procedures.
