Ginagawa lang ng House prosecution ang kanilang trabaho, salig na rin sa Saligang Batas.
Ito ang paliwanag ni House Minority Leader at lead prosecutor Marcelino Libanan sa kanilang naging hakbang na maghain ng mosyon sa Senado para maglabas ng writ of summons kay VP Sara Duterte kaugnay sa kanyang impeachment case.
Sabi ni Libanan, sumusunod lang sila sa sinasabi ng Konstitusyon na kailangang magsimula ang proceedings “forthwith.” Kung hindi aniya sila susunod dito, lalabas na nilalabag nila ang Konstitusyon.
“Alam niyo, lahat po kami ay sumunod, lahat po tayo dapat sumunod sa Konstitusyon. Kung sinasabi ng Konstitusyon that the proceedings shall start forthwith, e kailangan sumunod kami. Otherwise, pag hindi kami sumunod, kami na ang nagba-violate ng ating Konstitusyon,” sabi ni Libanan.
Dagdag pa niya, ang kanilang paghahain ng mosyon ay tumatalima sa Rules of Procedure sa Impeachment Proceedings ng Senado na kasalukuyang umiiral.
Gayonman, hindi rin naman aniya nila pine-pressure ang Senado.
“Yung aming ginawa is in accordance with the rules of procedure sa impeachment proceedings ng Senado. Na pag mayroong i-file, ay within 10 days bibigyan ng pagkakataon ang officer who is being sought to be impeached to answer in a period of 10 days. Parang ginigising lang namin ito—yung rules ninyo po. Kung may powers o wala, nasa kanilang quorum, nasa kanilang desisyon po ‘yan, pero ‘yan po ang ginawa nilang rules of procedure… We are not pressuring. We are doing our job,” sabi ni Libanan.
Hirit naman ni 1-Rider Party-list Rep. Rodge Gutierrez, una naman nang sinabi ni Senate President Chiz Escudero na handa ang Senado na maghanda para sa paglilitis.
At ang kanila aniyang paghahain ng entry with the motion of summons ay maituturing na preparatory step.
“As the good Senate President has mentioned, the Senate is ready to prepare for the trial. They are willing to go through the motions and any preparation that might be necessary even prior po. So in relation to the timeline, the motion filed by the prosecution through the Honorable Libanan—yung entry with the motion of summons—this could be considered one of those preparatory steps po.
So we are of the legal opinion that legally, they can tackle this matter even within the timeline that they have originally mentioned,” ani Gutierrez. | ulat ni Kathleen Forbes
