Korte Suprema, kinatigan ang mandatory coverage ng SSS sa mga OFWs

Pinagtibay ng Korte Suprema ang mandatory coverage ng mga Overseas Filipino Workers (OFWs) sa Social Security System (SSS), ngunit idineklarang labag sa Saligang Batas ang sapilitang pagbabayad ng kontribusyon bago makakuha ng Overseas Employment Certificate (OEC).

Ayon sa desisyon ng Supreme Court na isinulat ni Associate Justice Maria Filomena Singh, hindi maaaring gawing rekisito ang advance payment ng SSS contributions para sa OEC issuance.

Dahil dito, ipinagbabawal na sa SSS, Philippine Overseas Employment Administration (POEA), at Department of Labor and Employment (DOLE) ang pagpapatupad ng nasabing patakaran.

Nilinaw ng SC na bagamat obligado ang lahat ng OFWs na maghulog sa SSS, dapat ang gobyerno, sa pamamagitan ng Department of Foreign Affairs (DFA) at DOLE, ang makipagkasundo sa mga bansang pinagtatrabahuhan ng mga OFWs upang obligahin ang dayuhang employer na mag-ambag sa SSS contributions.

Samantala, nanindigan ang SC na hindi patas ang pagpilit sa land-based OFWs na bayaran ang buong kontribusyon bago pa man sila makaalis ng bansa.

Ayon sa Korte, ito ay isang pabigat sa mga manggagawang hindi pa nagsisimula sa kanilang trabaho at posibleng lumabag sa kanilang karapatan sa paglalakbay.

Sa kabila nito, nananatili ang mandato na dapat may SSS coverage ang lahat ng OFWs bilang proteksyon laban sa sakit, matinding aksidente, katandaan, at kawalan ng kita.  | ulat ni Lorenz Tanjoco
