Pagpepresenta ng e-Warrant of Arrest, pinapayagan sa batas ng Pilipinas; Akusasyon na warrantless ang pag-aresto kay FPRRD, walang katotohanan — isang ICC-accredited lawyer

Walang katotohanan ang mga binanggit sa pagdinig ng Senado kahapon kaugnay sa umano’y pagiging warrantless ng pag-aresto kay dating Pangulong Rodrigo Duterte, para sa mga kasong kinahaharap nito sa International Criminal Court (ICC).

“Mayroon pong Warrant of Arrest and it was issued by an international court na naging miyembro tayo. So, hindi po totoong warrantless arrest ito, dahil talagang mayroong warrant covering the arrest of the former President,” ani Atty. Joel Butuyan.

Sa Malacañang press briefing, sinabi ni ICC-accredited lawyer Atty. Jutuyan, na mayroong iprinisentang printed copy ng e-Warrant of Arrest sa dating Pangulo noong panahon na ito ay inaaresto ng mga awtoridad.

Paliwanag ng eksperto, kahit mismong e-copy lamang ng Warrant of Arrest ang bitbit ng mga awtoridad, pinahihintulutan na ito sa batas ng Pilipinas, alinsunod sa isinagawang Revisions of Rules of Court.

“In fact, puwede na sa atin iyong e-warrant na sinasabi doon sa revision ng ating rules of court,” dagdag pa ni Atty. Butuyan.

Sa International Criminal Court (ICC) aniya, paperless na ang kanilang proceedings, maging sa mismong trial.

“Even sa ICC mismo, hindi kailangang ipakita iyong physical Warrant of Arrest, dahil pupuwedeng e-Warrant din iyan. In fact, iyong proceedings ng ICC, even iyong kanilang trial, lahat, paperless na iyan… talagang e-documents lahat iyong ginagawa doon,” paliwanag ni Atty. Butuyan.

Bukod dito, kahit wala aniyang pisikal na kopya ng warrant na maipakita, pinapayagan pa rin ito, dahil ang mahalaga lamang, existing na ang Warrant of Arrest, sa mismong oras ng pag-aresto sa isang indibidwal.

“Sa batas mismo natin, hindi kailangang ipakita iyong physical Warrant of Arrest at the time of arrest. For as long as there exist a Warrant of Arrest, pupuwedeng mag-aresto,” diin ni Atty. Butuyan. | ulat ni Racquel Bayan
