Forgiveness clause sa Anti-Rape Law, pinaaalis ng isang mambabatas

Ipinapanukala ni 4Ps Party-list Representative JC Abalos na amyendahan ang Republic Act 8353 o Anti-Rape Law.

Partikular na pinababago ng mambabatas sa kaniyang House Bill 9083 ang Section 266-C o yung forgiveness clause.

Sa ilalim kasi nito, mapapawalang sala ang nanggahasa kung pakakasalan nito ang biktima.

Dahil kasi aniya sa probisyong ito ay sapilitang ipinapakasal ang mga biktima ng pang-aabuso para maabswelto sa kaso.

Maliban dito, nais din ng mambabatas na amyendahan ang Articles 45 at 47 ng Family Code, upang maisama ang rape bilang basehan o batayan para sa annulment o pagpapawalang bisa ng kasal.

Sa paraang ito mabibigyang pagkakataon ang mga biktima na ipinakasal, na makaalis sa pagkakatali sa mismong umabuso sa kaniya

“We seek to protect the unwilling victim against a coerced marriage with a rapist by giving them ample time to get an annulment. If we want to preserve the sanctity of marriage, no person should be coerced to marry the person who violates them. We must stop forcing the victim into a lifetime of indignity while their rapist evades punishment. It is high time that we rectify the harm brought about by an incoherent, antiquated, and unjust law, which does not conform with the current socio-political and cultural realities of the present society,” stressed Abalos.
