Nilinaw ni Independent Minority Representative Edcel Lagman na bagamat labag sa panuntunan ang ginawang pagbibigay ng confidential fund sa Office of the Vice President (OVP) mula sa contingent fund ay hindi ito sapat na batayan para maghain ng impeachment case.
Ito’y matapos makakuha ng kopya si Lagman ng Special Allotment Release Order o SARO kaugnay sa ginawang pagbibigay ng pondo ng Department of Budget and Management (DBM) sa OVP noong 2022.
Lumalabas sa SARO na ang ₱125-million na confidential fund na ibinigay sa OVP ay mula sa contingent fund ng Pangulo, bagay na hindi pinahihintulutan at paglabag sa power of the purse ng Kongreso.
“The contingent fund cannot be given to an agency as confidential funds when such agency has not been allocated any confidential fund in the 2022 GAA. Moreover, the contingent fund cannot be used for confidential expenses. The SARO is flawed and invalid,” paliwanag ni Lagman.
Ngunit nilinaw ng Albay lawmaker na ang pagkakamaling ito ay hindi sapat para mauwi sa impeachment case dahil wala namang intensyon na labagin ang panuntunan.
“There may have been only a misapplication or misinterpretation of the pertinent rules, but there seems to have been no intent to violate; but if this is repeated, then it will be [a] culpable violation,” sabi ni Lagman. | ulat ni Kathleen Jean Forbes
