Hindi pinagbigyan ng Sandiganbayan 5th Division ang mosyon ni Senator Jinggoy Estrada na makadalo sa impeachment trial ni Vice President Sara Duterte.
Sa 7-pahinang resolusyon ng korte, sinabi nitong walang sapat na merito ang mosyon at binigyang-diin ang mga naunang desisyon ng Korte Suprema, na nagsasabing ang isang opisyal ng pamahalaan na nasa preventive detention ay hindi maaaring gampanan ang tungkulin sa kanyang posisyon habang nakakulong.
Ayon pa sa korte, ang pagdalo sa impeachment trial ng tatlong araw kada linggo sa loob ng tinatayang 92 trial days o 31 linggo ay hindi na maituturing na emergency o temporary leave mula sa detention.
“Allowing the accused-movant to attend the impeachment trial would virtually make him a free man with all the privileges appurtenant to his position. It would not only elevate his status to that of a special class but also make a mockery of the purposes of preventive detention. To grant such request would substantially erode the very restraints that lawful detention necessarily entails”
Si Estrada ay nahaharap sa non-bailable na kasong plunder sa Sandiganbayan 5th Division na may kaugnayan sa umano’y ₱573 milyong flood control anomaly.
